The purpose of this Terms of Use is to define the rights, obligations and matters of responsibility between the ‘Company’ and the ‘user’ pertaining to the reservation for the carriage of passengers (hereinafter referred to as ‘user’) via International Taxi. It also applies to the use of supplementary services through a separate service use contract or use of the International Taxi Call Service (hereinafter referred to as ‘ITCS’) operated by the Korea Smart Card (hereinafter referred to as ‘Company’).

• ①’Company’ refers to the Korea Smart Card, or the party who is entrusted with the work of the ‘Company’, and acts as an intermediary in the signing of contract of carriage between the ‘user’ and International Taxi drivers after receiving an application for the use of the supplementary services and the ‘user’s ‘ITCS’.
• ②’User’ refers to the party who agrees with the Terms of Use and who wishes to utilize the ‘ITCS’ and its supplementary services. ‘User’ shall include the passenger who boards the International Taxi, in actuality.
• ③’ITCS’ refers to the service that the ‘Company’ provides as an intermediary for the signing of contract of carriage. Once the ‘Company’ has received a request for carriage from a ‘user’ it then notifies the party to be responsible for the carriage via International Taxi. Supplementary services shall refer to the services provided by the ‘Company’ or International Taxi drivers according to the ‘user’s request or for the user’s convenience in relation to the ITCS service.

• ①The Terms of Use shall apply to the International Taxi reservations and supplementary services, using the ‘ITCS’ provided by the ‘Company’.
• ②If and when there is a need to sign a separate contract besides this Terms of Use, the ‘Company’ and ‘user’ may sign the separate service use contract.
• ③If and when the ‘Company’ and ‘user’ sign separate service use contract, according to Sub Article 2, the matters not decided separately shall be subject to the Terms of Use. This will be done by applying the applicable statute to the conditions defined in the Terms of Use.

The reservation of carriage or the contract of supplementary service use shall be concluded according to each of the following Sub Articles.

• ①When reservations for carriage or supplementary services with ‘ITCS’ are made via the phone or Internet and a reservation number is issued.
• ②When signing separate service use contract.
• ③When the ’Company’ receives separate deposit money, on behalf of the International Taxi drivers, in relation to the ‘ITCS’ and use of supplementary services, and when this deposit money is deposited or paid with credit card.

The ‘Company’ shall apply the Terms of Use when the service use contract has been signed, according to Article 4, and assuming the ‘user’ has agreed to the Terms of Use.

The types of carriage fee are described in the Sub Articles below. The detailed fees shall be posted up separately on the Internet (www.intlTaxi.co.kr)

• ①Taximeter fare system: System of payment calculated based on the existing meter fee.
• ②Flat fare system: System of payment that shall apply when traveling to specific zones or when Taxi is chartered.

The ‘Company’ shall not supply the personal information it obtains from a ‘user’, when they utilize the ‘ITCS’, to a third party without the prior consent of the applicable ‘user’. Additionally, the information shall not be used for any purposes that are not specified herein. If and when this Article is violated, the ‘Company’ shall assume all responsibility. However, the following cases shall be exempted.

• ①If and when the ‘user’s’ information is required so as to make reservations for carriage or the use of additional services, on behalf of the ‘user’, it shall be provided to a company entrusted by the International Taxi drivers or the ‘Company’ to facilitate said services.
• ②If and when needed for the drafting of statistics, academic research or market research and if and when provided in a form that the specific individuals cannot be identified.
• ③If and when there is an obligation to provide information in accordance with other related laws.

• ①The ’Company’ shall not engage in an act that is prohibited by law and the Terms of Use, and it shall provide ‘ITCS’ and supplementary services in a continual and stable manner as specified in the Terms of Use.
• ②The ’Company’ shall install a security system to protect the personal information of a ‘user’, so that the safety of a ‘user’ employing the ‘ITCS’ has been adequately accounted for.
• ③The ’Company’ shall assume the obligation of due diligence as a good management party when it comes to the provision of the ‘ITCS’ and supplementary services.

• 1. The ’User’ shall comply with the laws, the regulations of the Terms of Use, the instructions for the use of the ‘ITCS’ and other matters specified by the ‘Company’. The ‘user’ shall not engage in the act that may interfere with the ‘Company’ carrying out its specified tasks.
• 2. The ’User’ shall agree to receive e-mails, SMSes and phone calls related to the use of the ‘ITCS’.
• 3. The ’User’ shall not engage in each of the following Sub Articles in relation to the ‘ITCS’ and the use of its supplementary services.
• 4. Notification of false information at the time of applying for the ‘ITCS’ and use of its supplementary services.
• 5. Act of signing separate reservations for carriage or contract with International Taxi drivers using the International Taxi related information obtained during the process of using the ‘ITCS’.
• 6. Other acts that may interfere with the ‘Company’ carrying out its specified tasks.
• 7. The ’User’ shall agree to provide the personal information requested for use of the ‘ITCS’ and its supplementary services.
• 8. The ’User’ shall notify the ‘Company’ about the cancellation or any change to a reservation once that ‘user’ has made a reservation for carriage using the ‘ITCS’. Notification must be made at least three hours prior to the start of the carriage service. If and when the ‘user’ does not comply with this obligation to notify the ‘Company’, then the ‘Company’ reserves the right not to return part or whole of the deposit money.

• ①The ’Company’ may provide the information required for use of the ‘ITCS’ and its supplementary services to the ‘user’ via e-mail, SMS or phone.
• ②The ’Company’ may entrust specific duties of the ‘ITCS’ to another company. In this capacity, the ‘Company’ may also entrust the personal information of the ‘user’, related to the use of the ‘ITCS’ and its supplementary services, to the company in question.

• ①Unless there are unforeseen circumstances regarding its duties or technology, the ’ITCS’ shall be available 24 hours a day, 365 days a year.
• ②If and when the hours of operation for the ‘ITCS’ shall change, the ’Company’ will post up the new hours on its website (www.intlTaxi.co.kr).

• The ‘Company’ may refuse a request for a reservation if and when there shall be a reason that corresponds to one of each of the following Sub Articles.
• 1.If and when the allocation of vehicles prohibits a reservation being made at the time requested by the ‘user’.
• 2.In cases where a certain ‘user’ has violated the Terms of Use at least twice.
• 3.If and when the ‘ITCS’ and its supplementary services cannot operate normally due to system malfunctions, etc.

• ①In relation to the ’ITCS’, the ‘Company’ may assume responsibility for any actual damage incurred, within the full amount of the deposit paid by the ‘user’, in the situations stated in the sub Articles below.
• 1.If and when the ’Company’ made a reservation that differs from the ‘user’s’ original request for the International Taxi and its supplementary services.
• 2.If and when the ’Company’ does not notify the ‘user’ in advance after receiving notification that contract of carriage by the International Taxi drivers is impossible, due to changes in circumstances, following completion of the reservation. However, there shall be an exception if and when notification in advance is impossible due to the severance of contact with the ‘Company’ by the ‘user’.
• ②In relation to the ‘user’s utilization of the ‘ITCS’, the ’Company’ shall not assume responsibility for any damage incurred due to the situations described in the Sub Articles below Taxi.
  • 1.Non-execution of the obligation of the contract of carriage once the reservation for the allocation of a vehicle has been completed.
  • 2.Illegal acts.
• ③The ‘Company’ shall not be responsible for any damage incurred due to any intentional act, mistake or non-compliance to the Terms of Use, on behalf of the ‘user’.
• ④The ‘Company’ shall not be responsible for any damage incurred if and when the use of the ‘ITCS’ is rendered temporarily impossible due to such occurrences as natural calamities, system errors, etc.
• ⑤The ‘Company’ may record details of the ‘user’s’ utilization of the ‘ITCS’ in relation to the scope of its responsibility.

The ‘Company’ retains the copyright and other intellectual property rights for any and all copyrighted materials drafted by the ‘Company’.

• ①The ’Company’ shall immediately take into consideration any justified opinions or complaints raised by ‘user’.
• ②The ’Company’ shall make every effort to ensure a favorable agreement between the ‘user’ and the International Taxi driver can be reached when damage resulting from non-execution of the reservation or during travel is reported.

• ①The ’Company’ shall post up the details of the Terms of Use on its website (www.intlTaxi.co.kr).
• ②If and when the Terms of Use shall be modified, any modifications shall be posted on the ‘Company’s website (www.intlTaxi.co.kr), and the modifications shall come into effect 14 days after being posting.

If and when there shall be disputes arising from the Terms of Use, the two parties shall reach an agreement based on mutual understanding. However, if and when a dispute cannot be resolved, the court in jurisdiction shall be the Seoul Central District Court, based in Seoul, Korea.
